Photo showing a personal injury car accidentIf you have been injured in an accident that you believe was caused by the negligence of another, here are some things that you SHOULD do immediately:

Seek immediate medical attention!

It is important to seek immediate medical attention following the accident to ensure that there are no internal injuries or any other hidden issues that could later surface.

Contact a Lawyer!

If you or a loved one has been seriously injured, do not try to handle a claim on your own or risk using an inexperienced lawyer. The Fernandez Law Group promises to provide every client with high quality legal representation and are committed to recovering the maximum compensation for each case.

Call your Insurance Agent!

Whether you were at fault for the accident or not, you should contact your insurance agent as soon as possible to notify them of the incident. However, any statements, notes, or additional information requested by your agent or any other agents should only be done at the discretion of your attorney.

Photo showing an auto accident with two driversDifferent types of negligence resulting in auto accidents:

Everyone is expected to maintain proper care when operating an automobile. And generally speaking, almost all car accidents, whether intentional or not, are directly caused by the negligence of another party. The following are the most common types of negligence we see in car accident cases involving personal injury that our law firm handles:

• Failure to be aware of their environment, surroundings, or not seeing other drivers and pedestrians.

• Failure to maintain proper speed, whether exceeding the speed limit or driving too slow.

• Tailgating, or following entirely too closely behind another driver.

• Failure to yield to a right of way.

• Running red lights and stop signs, or failing to stop at red lights or stop signs.

• Losing control of the vehicle, reckless or careless driving.

• Unable to stop in time, rear end collisions, failure to use the brakes properly.

While this list is far from complete, it does represent the majority of the types of cases we see. Proving negligence in these situations in order to ensure the defendant assumes liability for your injury and claims requires your attorney to show that the defendant was the “proximate cause” of your injuries.

Photo showing DUI checkpoint aheadReasons why you should plead Not Guilty in a DUI case:

There are a multitude of factors, whether known at the time or not, that will come into play when defending a DUI case.

It is very important for all defendants to remember that a DUI case is something that can be won!

Although the majority of people may have a difficult time understanding this concept, the truth of the matter is that many defendants will think that they have to plead guilty because they felt they may have been in the wrong. Our expert advise or opinion to anyone facing a DUI charge would be:

Do not plead guilty, or admit guilt, even if you think you’re guilty.

There are plenty of reasons why that advice should strongly be considered, but to put it in simple terms, a DUI case isn’t won or lost based on the actions of the defendant alone. In many situations, the actions or inactions of how the police or sheriff performed their stop become big factors in these types of cases more often than one might expect.

Personal Injury Victim being helped by medical teamWhy Do I Need a Lawyer for My Personal Injury Case?

If you had a heart condition that needed surgery, you wouldn’t try to fix it yourself—would you? In situations that involve serious injuries that have damaged your health, someone who is a true expert on the subject and has a long track record of achieving successful outcomes will be well worth your investment.

1. Insurance Companies Do Not Have Your Best Interests at Heart:

Insurance companies are ultimately trying to protect their bottom line—not to compensate you fairly for injuries. Hiring an attorney can be the best way to ensure you have an advocate protecting your interests.

2. Statute of Limitations:

Statutes of limitation vary by location. If the process is not completed within a certain time frame, you will lose your rights in the state of Florida. An experienced auto accident attorney can properly identify which statute of limitations rule applies to your specific situation.

3. Filing Your Personal Injury Claim Entails Compliance With Strict Rules:

Dealing with the paperwork, rules, and regulations associated with filing a Florida personal injury claim is a complex task. An experienced personal injury attorney can guide you through the process required by your state to file.

4. Damages Due to Your Injuries May Be More Extensive Than You Think:

Florida laws define damages under several different categories like pain, mental duress, medical expenses and more. Without an experienced attorney who is aware of the laws in the jurisdiction of your accident, you may literally give money away.

5. Proving Your Case Is Complicated:

Filing your case is very complex. Proving your case, even more so. Having a legal professional experienced in ascertaining all of the factors is absolutely CRITICAL.

If you have suffered a personal injury due to an accident involving a boat, car, truck, motorcycle, large truck, 18-wheeler or negligence due to lack or security or premesis liability, you may be entitled to compensation for lost wages, medical expenses and more.

Our Lawyers have experience in all types of personal injury claims and we work aggressively on your behalf to get you the best outcome for your situation.
